No one likes to go to court. Well, perhaps the judges and the lawyers enjoy it, as well as the occasional clerk, but as a general rule, most people don't exactly relish the experience. Whether you're there for a speeding ticket or a lawsuit, it's important to know how to act.

Should you find yourself in court for a civil matter (i.e., a lawsuit), the way that you carry yourself can have a big influence on the outcome of your case. Whether you're there as a plaintiff (the one who filed the lawsuit) or as a defendant (the one whom the lawsuit was filed against), it's important to remember to be polite and not to overreact.

Most likely, the other party in your lawsuit is someone that you know on some level. It could be an ex-boyfriend or girlfriend, a business partner, or even a family member. And while it's true that there are lawsuits that occur against parties that you don't know personally and companies that only have their lawyers representing them, the likelihood of facing someone that you know is much higher than facing someone you don't know. For you, this also usually means a very high emotional involvement in the proceedings.

No matter what circumstances brought you to court, you always need to remember to stay calm and collected. Be polite, both to the judge and to the other party in the lawsuit. Not only will it help you to appear level-headed and reasonable, but it will also keep the judge from becoming irritated at your antics and having you serve from 5 to 30 days in jail for contempt of court. After all, if a lawsuit is getting you upset, just imagine what a week in jail would do?

Address the judge as "Your Honor", and the other party by their last name (with the appropriate title, such as "Mr." or "Ms."). Make sure that you have all of the information that you need at hand to present to the court, and try not to react if the other party in the suit becomes upset or begins yelling/crying/etc. 

Speak only when you're spoken to, and take special care not to interrupt the other party or their attorneys while they are talking to the judge. You'll have your turn to say all that you need to say and to present all of your evidence and information. Try your best to be as patient and polite as you can at all times.

Most importantly, keep in mind that a lawsuit is a civil matter. Unless you upset the judge, no one is facing any jail time. It's usually a simple matter of money on the line. Yes, it can sometimes be large amounts of money, but there are much worse things than losing money.

In the end, the decision in the case will rest with the judge. Your attorney is there to help make sure that everything goes as much in your favor as it can, but it's up to you to make sure that you don't make his job more difficult by acting inappropriately in court.
