21. Clearly the mom is lying and is money hungry. If the hot chocolate was that hot, she would not have even been able to handle the cup in order to give it to her child! She would have known from touching it that it was too hot for her child. Only she is to blame for this incident. 22. I'm just wondering why it took the mother over 2 years to file a lawsuit, the article states that the incident took place on Nov 2, 2004...it's completely asinine to file a lawsuit on an incident that allegedly happened over 2 years ago, and I wonder how many times she has been back to Starbuck's since? 23. I don't agree with frivolous lawsuits and I do think People are looking for ways to make a quick buck. I would say we do not have all of the details here and If we did I might feel something completely different. But what I am seeing is that Evidently Starbucks has a policy on the temperature of "kid size drinks" If this childs drink caused a burn (regardless if the skin was falling off or not) then it was hotter than what company policy was. The customer had a reasonable expectation that the policy was followed. Therefore the mother possibly used poor judgement but was not negligent.As far as spill proof lid, Starbucks drinks come with lids, they are not "spill proof" . Most children 3 or 4 could manage that without too much difficulty does that mean they WON'T spill it ..of course not I know, I spill stuff ALL the time. So again I would not call the mother negligent. 24. I am not a fan of Starbucks, but this not a question of vender. It is a question of when or we going to take responsibility for our own actions!!! Yes it is a bad thing when a child or anyone gets hurt,but common now. Small child (needs to be in car seat) moving car and hot drink. The parent's are to blame not Starbucks. If it was Iced coffee and it spilled would Starbucks have to pay to clean the car too ? Our courts are loaded with stuid lawsuits I say enuogh and grow up. 25. Things common in the 21st Century: 26. I think that the parents made a mistake for giving a hot chocolate to their child while the car is running and i dont think they should be blaming someone else from their mistake. I love starbucks and i like my coffee or hot chocolate to be hot as in hot! thats what it should be and besides you can always ask for some ice if its too hot. 27. The parent has to be held responsible in this case. THEY should have received the drink, tested it and then and only then, given it to the child. 28. The Brennan's should feel lucky that Children's Services haven't stepped in and charged them with child endangerment. They should be made by the courts to take a safety class on caring for children! 29. On second thought, I think the mother did it to the child for the money...I agree, Only In America!! 30. Did the mom tell them it was for a toddler? NOT that it matters, I agree, hot drinks for a child that young shows ignorance of the parent....witha bottle, don't they put a "test" of the liquid on their wrist to check the temp? 31. This is ridiculous. Whether it's the McD's or the Starbucks case, if something is hot enough to burn and make the "skin fall off," then it should be hot enough to destroy the cup! When you buy something hot, can't you tell SOMEthing about the temp just by holding the cup? And don't you usually take a tiny sip just to make sure it's not too hot? Geez!!! Sounds to me like the parents need a neglect & child endangerment investigation by their local Protective Services agency. 32. In both this case and tne McDonalds case, the adults need to assume responsibility for their own actions. When I go for a cup of coffee, I want HOT coffee, not something luke warm. If I am drinking and driving at the same time and manage to spill the coffee, that's my fault. In the Starbucks case, it is the parents' duty and obligation to protect their child. If they realized that the drink was too hot, they should have held it back until it cooled a bit before giving it to the child. But then, it is easier to be stupid and then sue than to be smart in the first place. 33. Just for info, while reading #8, I laughed so hard that I fell and broke my ankle. #8 I'm going to sue you for putting something in writing that may make someone lose his or her balance. I'm also going to sue AOL for allowing them to put something on the site that may cause someone to lose balance while they read it. What do you think? How bout 100 million. Sounds good to me. P.S. I'm going to sue sony for creating a lap top computer that can be carried in a manner that someone could read the screen while walking. 34. You're kidding, right? Is there anyone left in this country who will take responsibility for their own actions and not insitute yet another stupid, frivolous lawsuit to cover their ineptitude? I'd like to sue the parents for having a child while being this stupid.... 35. I have children and would never ever consider giving them a hot beverage without my supervision. I believe what you may have here is a couple who maybe think they can quit there jobs and live large based on the funds they think they will receive. No mother would ever give there child a hot beverage unless they are seeking the ability to quit there jobs. I am so sorry for this child and CPS should be called to see if there is neglect for this child by the parents. 36. How much you want to bet something already happened to that kid AT home??? And they drove there to get that hot chocolate, just so they could sue the company and get the company to pay for thier medical bills. I bet you they don't have insurance. 37. As a person who works in the Quick Service Industry, I believe that I have a responsibility to ensure my products are served at safe levels, be it sanitary or temperature related. As a parent, I feel that it is my responsibility to double check all risk's associated with my child, and as a parent it falls on me alone, not someone else. 38. The McDonald's suit was just as ridicules as this one. Excuse me but why would anyone put a hot drink between their legs? As an adult when I get a cup of coffee I know it's hot and I wouldn't want to put it any where that it would have a risk of spilling and burning myself. The woman who won the suit against McDonalds was old enough to know coffee is hot. The trouble with America is there are lawyers who will go after anything if they believe they can get a buck out of it. We have become a sue happy culture. Everyone wants money for their own stupidity. Maybe they should get a job and work for a living. 39. The parental neglect should be reported to Indiana Child Welfare. Regardless of the source of the drink hot enough to burn a child, the adult is responsible, especially if they gave the drink to the child. This is displaced guilt....... Guilty Adult blaming someone else for their neglect and failure. The hospital where this child was treated should have reported the incident. 40. Wow, it's hard to believe anyone would be stupid |
