If you have ever purchased a defective product only to be told by the manufacturer that nothing would be done about it, lemon laws were created to help in just such a situation.  Lemon laws cover most types of consumer goods from appliances to automobiles, yet laws do vary from state to state.  

How do I know if my purchase will be covered by lemon laws?

It is necessary to locate and examine your state's laws concerning product liability.  Look up your state's official website and search lemon laws to find out exactly which types of purchases are covered.  For example, in many states, any new vehicle that develops a defect within the year after purchase or before the warranty runs out -whichever comes first- is usually covered by lemon laws.  

How serious does a defect have to be?

In the case of a motor vehicle, the defect must be serious enough to affect significantly the resale value, the function, or the safety of your car or truck.  If your vehicle has a safety defect, consider reporting it to the National Highway Traffic Safety Administration, U.S. Department of Transportation. Your report could possibly lead to a safety recall, which would also help others experiencing the same problem.      

How do lemon laws work?

Again, a good example is how lemon laws apply to vehicles.  If you purchase a car or a truck that continues to have the same problem, you may have standing to sue.  In many states, if a vehicle has required repair of the same defect four or more times within one year, but is still not working properly, the vehicle would be covered by lemon laws.  Also, if a vehicle has been out of service for thirty days or more within one year of purchase, or within the warranty period, it should be covered.  

What are my rights and my responsibilities?

You have the right to contact the company and seek recourse.  If this option fails, you can take the manufacturer to court.  There are certain responsibilities you must fulfill before filing suit, such as giving the manufacturer an opportunity to repair or replace the item.  In some cases, you may be required to engage in mediation before attempting to file suit, but you have the right to refuse any settlement that you do not find satisfactory.  Also be aware of clauses in the original lease or purchase contract that claim you have waived your rights.  Such clauses are void and lemon laws still apply to defective purchases, so don't be fooled.  

Are there lemon law lawyers?

Yes, there are attorneys that specialize in such cases.  A licensed attorney in your area should be well versed in the lemon laws of your state.  Most lemon law attorneys offer a free initial consultation and only charge you for their services if they win your case.  They may also try to get the other party to pay for their services by asking the judge to include attorney's fees in the settlement.
