The process of selling a home is a complex, legal journey. It is important to be confident in your desire to sell before entering into contracts; if you change your mind too late, you may be legally bound to sell your home. Learn at what points in the process you can legally change your mind. 

Listing your home

While most people opt to use a real estate agent when selling homes, it is possible to place a house on the market yourself. One advantage of selling a home yourself is you may remove the home from the market at any time before you enter into a contract with a buyer, without any ramifications. If you do choose to sell without an agent, however, it is wise to consult with a real estate attorney to ensure the sales transaction is conducted properly. 

If you list a home with a reputable real estate agent, you will be asked to sign a contract called a listing agreement. Listing agreements vary in different areas, however most listing agreements will spell out the duration of the agreement and the commission that must be paid to the agent when the house is sold. This contract also may call out conditions under which you agree to sell your home; generally this is if the real estate agent presents you with a full price offer from qualified buyers who agree to purchase your home. It is important to carefully read your listing agreement as this is a legally binding contract and penalties may be enforced if you default on any portion of it.

If you know up front that you may have reasons not to complete the sale with the listing agent, make sure these circumstances are covered by your agreement. For example, if you are being relocated by your company, and the company will assume the loan and sell  it after a set time period on the market, make sure your agent knows this and the contract calls out these circumstances. 

If you have listed your home with an agent and signed a listing agreement, but have decided not to sell you have a few options. Consider the term of the agreement; if the duration of the agreement is nearly over, your best option may be to simply allow it to expire and hope no valid offers come in. If you do have valid purchase offers, you are not legally obligated to accept one and sell your home. However, you may owe your real estate agent a commission because he fulfilled his portion of the contract and presented you with a buyer. 

Once you have a buyer

If you have accepted an offer on your home and have entered into a contract with a buyer, it can be difficult to cancel the deal. When an offer is presented to purchase your home, you are not obligated to the potential buyer; however, once you accept the offer, or make a counter offer, you are legally obligated to the terms of the agreement. At this point, if you choose not to sell your home, you are in breach of the contract and the buyer may sue; a court judgment could require you to complete the sale, or to pay monetary damages. 

It is unusual for a seller to include contingencies in the purchase offer, however if you spell out conditions in the purchase agreement under which you will not complete the sale, you have the right to use these conditions to abort the transaction. 

In addition, if you are reticent to sell, you may find the buyer¡¯s contingencies useful. For example, if the buyer requests repairs or a price adjustment to the home as part of their inspection process, you may always refuse to make the repairs or modify the sales price. This may discourage the buyer and cause them to legally terminate the contract.
